Effective Date: August 2, 2026
Last Updated: August 2, 2026
Welcome to pinehurstconfidant.com. These Website Terms and Conditions of Use (“Terms”) govern your access to and use of the Pinehurst Personal Confidant LLC website, including its pages, forms, scheduling features, payment features, and related online content (collectively, the “Site”).
Pinehurst Personal Confidant LLC is a Colorado limited liability company referred to in these Terms as “Pinehurst Personal Confidant,” the “Company,” “we,” “us,” or “our.”
By accessing or using the Site, you acknowledge that you have read and agree to these Terms. When the Site asks you to check a box, click an acceptance button, submit a form, schedule an appointment, or complete a payment, that action constitutes your electronic agreement to the terms presented to you.
If you do not agree with these Terms, do not use the Site.
1. Scope of These Terms
These Terms apply only to your use of the Site.
They do not, by themselves, establish or govern a paid Personal Confidant relationship. Any actual services provided by Pinehurst Personal Confidant are governed by a separate, signed Client Services Agreement and any associated confidentiality, payment, cancellation, or service documents.
If these Terms conflict with an executed Client Services Agreement concerning paid services, the Client Services Agreement will control. The collection and use of personal information through the Site are also governed by our Privacy Policy.
2. About Pinehurst Personal Confidant
Pinehurst Personal Confidant offers private, independent Personal Confidant relationships for adults who want a discreet place to speak openly, think through personal and professional decisions, recognize patterns, organize choices, and maintain direction over time.
The term “Personal Confidant,” and any related description such as “Thinking Partner,” describes the nature of the Company’s nonclinical service. These terms do not represent a professional license, clinical credential, or fiduciary role.
All services are subject to availability, professional fit, established boundaries, and acceptance by Pinehurst Personal Confidant.
3. No Relationship Created Through the Site
Visiting the Site, reading its content, submitting an inquiry, requesting a consultation, scheduling an appointment, communicating by email or text, or making a payment does not automatically create a Personal Confidant relationship, a professional relationship, a fiduciary relationship, or any other formal relationship with Pinehurst Personal Confidant.
A formal Personal Confidant relationship begins only after:
Pinehurst Personal Confidant has accepted the prospective client;
Both parties have signed the applicable Client Services Agreement; and
Any required initial payment or onboarding requirements have been completed.
A consultation or introductory conversation is intended to evaluate fit and does not guarantee that services will be offered.
4. No Emergency or Crisis Services
The Site and its contact methods are not crisis resources and are not monitored continuously.
Do not use the Site, an inquiry form, email, text message, scheduling system, or other Company communication method to request emergency or crisis assistance.
If you or another person is in immediate danger, call 911 or go to the nearest emergency room. If you are in the United States and experiencing emotional distress or a mental-health crisis, call or text 988 to reach the 988 Suicide & Crisis Lifeline.
Pinehurst Personal Confidant does not provide crisis intervention, suicide prevention, emergency response, or mental-health treatment.
5. Adult Eligibility
The Site and Pinehurst Personal Confidant services are intended for adults.
You must be at least 18 years old and legally capable of entering into a contract to submit an inquiry, schedule a consultation, make a payment, complete an intake form, or engage the Company’s services.
Individuals under 18 should not submit personal information through the Site.
6. Permitted Use of the Site
You may use the Site only for lawful, personal, and legitimate purposes.
You may not:
Use the Site in violation of any applicable law or regulation;
Submit false, deceptive, fraudulent, threatening, harassing, abusive, or unlawful information;
Impersonate another person or misrepresent your identity;
Attempt to obtain unauthorized access to the Site, its systems, or another person’s information;
Introduce viruses, malicious code, or other harmful technology;
Interfere with the operation, availability, security, or performance of the Site;
Scrape, copy, harvest, or systematically collect Site content or information without written permission;
Use Site content to create a competing service or commercial product;
Infringe the intellectual-property, privacy, confidentiality, or other rights of the Company or another person; or
Use the Site to conceal, facilitate, or request assistance with illegal activity.
We may restrict or terminate access to the Site when we reasonably believe these Terms have been violated.
7. Inquiries, Scheduling and Availability
Submitting an inquiry or scheduling request does not guarantee an appointment, acceptance as a client, or availability of services.
We may accept or decline prospective clients based on availability, professional fit, service boundaries, potential conflicts, the nature of the requested assistance, and other lawful business considerations.
Appointment availability shown through a scheduling provider may change. We may need to reschedule or decline a requested appointment.
8. Fees, Payments and Recurring Services
Prices, payment schedules, initial commitments, recurring charges, cancellation rights, rescheduling policies, refunds, and termination terms will be disclosed through the applicable checkout process, payment authorization, and Client Services Agreement.
Where services involve automatic or recurring payments, the applicable renewal terms and cancellation instructions will be presented separately for your review and affirmative consent.
General information displayed on the Site does not modify the financial terms of a signed Client Services Agreement.
If a payment is processed by a third-party payment provider, that provider may apply its own terms and privacy practices.
9. Privacy, Discretion and Website Submissions
Your use of the Site is subject to our Privacy Policy.
Pinehurst Personal Confidant values privacy and discretion. However, Internet communications, website forms, email, scheduling systems, payment systems, and text messaging carry inherent privacy and security risks.
Information submitted through the Site:
May be processed or stored by third-party technology providers as described in our Privacy Policy; and
Should be limited to the information reasonably requested by the applicable form.
Do not use a general inquiry form to send highly sensitive information, detailed medical or mental-health information, financial account information, Social Security numbers, passwords, information about illegal activity, or emergency communications.
Any contractual confidentiality commitments applicable to an accepted client will be stated in the signed Client Services Agreement or a separate written Confidentiality Agreement. Such commitments may be subject to legal requirements, court orders, subpoenas, imminent-safety concerns, applicable reporting obligations, and disclosures authorized by the client.
10. Email, Telephone and Text Communications
If you provide an email address or telephone number, you authorize Pinehurst Personal Confidant to respond directly to your inquiry and communicate with you regarding scheduling, requested services, payments, or other administrative matters.
Providing a telephone number through a general inquiry form does not constitute consent to receive automated marketing calls or marketing text messages. Any automated or promotional communications requiring separate consent will be offered through a separate, clear opt-in process.
Email and text messages may not be secure. Do not send highly sensitive information through these methods unless specifically requested and an appropriate communication method has been established.
Message and data rates may apply based on your service provider.
11. Intellectual Property
Unless otherwise stated, all Site content—including its text, service descriptions, logos, graphics, photographs, videos, designs, layouts, branding, downloadable materials, and other original content—is owned by or licensed to Pinehurst Personal Confidant LLC and is protected by copyright, trademark, and other intellectual-property laws.
You may view and print a reasonable portion of the Site for your personal, noncommercial use.
You may not reproduce, republish, distribute, sell, license, modify, publicly display, create derivative works from, or commercially exploit Site content without prior written permission.
The Pinehurst Personal Confidant name, logo, visual identity, and related branding may not be used in a manner that suggests endorsement, affiliation, or authorization without written permission.
12. Third-Party Services and Links
The Site may use or contain links to third-party websites and services, including scheduling providers, payment processors, analytics providers, communication services, social-media platforms, or other external resources.
Pinehurst Personal Confidant does not control and is not responsible for the availability, content, security, accuracy, terms, or privacy practices of third-party websites or services.
Accessing or using a third-party service is at your discretion and may be subject to that provider’s separate terms and privacy policy.
13. Testimonials and No Guarantee of Results
The Site may include testimonials, examples, general observations, or descriptions of situations in which a Personal Confidant relationship may be helpful.
Testimonials describe individual experiences and do not guarantee that another person will receive the same or similar results.
Personal, professional, relationship, business, and decision-making outcomes depend on numerous circumstances outside the Company’s control. Pinehurst Personal Confidant does not guarantee any specific result or outcome.
14. Accessibility
Pinehurst Personal Confidant is committed to providing an inclusive and accessible digital experience.
Information concerning our accessibility efforts and how to report an accessibility concern is available in our Accessibility Statement.
Nothing in these Terms limits any accessibility right or accommodation required by applicable law.
15. Disclaimer of Warranties
To the fullest extent permitted by law, the Site is provided on an “as is” and “as available” basis.
Although we make reasonable efforts to provide accurate and useful information, we do not guarantee that the Site will always be complete, current, uninterrupted, error-free, secure, or free from harmful components.
We may update, remove, correct, or modify Site content without notice.
These disclaimers do not excuse false or misleading representations and do not limit any right that cannot legally be waived.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Pinehurst Personal Confidant LLC and its owner, representatives, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from your access to, use of, reliance on, or inability to use the Site.
17. Responsibility for Unlawful Misuse
To the extent permitted by law, you agree to be responsible for losses, claims, or reasonable expenses resulting directly from your unlawful misuse of the Site, intentional violation of these Terms, infringement of another person’s rights, or submission of content you were not legally authorized to provide.
This section does not require you to reimburse the Company for losses caused by the Company’s own unlawful conduct, gross negligence, or willful misconduct.
18. Suspension or Termination of Website Access
We may suspend, restrict, or terminate access to the Site if we reasonably believe that a user has violated these Terms, threatened another person, attempted to compromise the Site, submitted unlawful requests, or misused the Site.
Termination of Site access is separate from termination of an existing client relationship. Termination of paid services is governed by the applicable Client Services Agreement.
Sections that by their nature should survive termination—including intellectual-property protections, disclaimers, limitations of liability, and governing-law provisions—will remain effective.
19. Changes to These Terms
We may update these Terms to reflect changes in the Site, Company practices, services, technology, or applicable law.
The revised Terms will be posted on this page with a new “Last Updated” date. When appropriate, we may also provide additional notice of a material change.
Changes apply prospectively from their effective date. Continued use of the Site after the revised Terms become effective constitutes acceptance of the revised Terms where permitted by law.
20. Governing Law and Venue
These Terms are governed by the laws of the State of Colorado and the State of North Carolina, without regard to its conflict-of-law principles.
Subject to any non-waivable consumer rights or jurisdictional requirements, disputes arising solely from these Terms or use of the Site must be brought in a state court located in Larimer County, Colorado, or in a federal court with jurisdiction in Colorado.
21. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect, and the affected provision will be interpreted as closely as legally permitted to its original purpose.
A failure to enforce a provision does not waive the right to enforce it later.
Headings are included for convenience and do not control interpretation.
These Terms, together with the Privacy Policy and any notices expressly incorporated into them, constitute the agreement concerning use of the Site. They do not replace an executed Client Services Agreement governing paid services.
